Reyes goes craft with Windy City deal









Independent breweries are still a niche category in the marketplace, but interest in them continues to grow.


Reyes Beverage Group, a division of global food and beer distributor Reyes Holdings of Rosemont, said Sunday it has reached an agreement to purchase Windy City Distribution, a well-regarded distributor of craft beers.


Brothers Jim and Jason Ebel founded Windy City in 1999. The firm operates as a distributor across eight northern Illinois counties for more than 40 craft breweries, such as Tyranena, Lagunitas and Jolly Pumpkin Artisan Ales. The Ebels also are the brewers behind Warrenville-based Two Brothers beer.





The deal, which is expected to close by the end of the year, is yet another sign of the coming-of-age of the craft beer scene, which is now much more part of the mainstream beer industry. In 2012, 442 craft breweries opened, according to the Beer Institute. The Brewers Association, a trade association, said sales of craft brews increased 14 percent in the first half of 2012 and volume jumped 12 percent.


While the beer industry overall has shown limited growth, the explosive interest in craft beer is enticing giants such as Anheuser-Busch, the maker of Budweiser, and MillerCoors, both of which have struggled to enter the craft market on their own. Since acquiring Chicago's Goose Island in 2011, Anheuser-Busch has aggressively expanded that well-known label. Earlier this year, it revealed plans to increase Goose Island's distribution to all 50 states, making it one of the few craft brands with a true national footprint.


Reyes' Chicago Beverage Systems and Windy City will not integrate their operations. Windy City's president, Bob Collins, and his management team will join Reyes. Chicago Beverage Systems distributes Miller, Coors and Heineken brands, among others.


"Windy City Distributing will be a new entity in our network focused solely on the craft beer market," said Ray Guerin, chief operating officer of Reyes Beverage Group. "I look forward to working with Windy City to learn more about servicing the craft beer industry while providing Reyes Beverage Group's expertise to help Windy City expand."


Terms of the transaction were not disclosed. Both companies are privately held.

RIM begins BlackBerry 10 tests with business, government clients






TORONTO (Reuters) – Research In Motion Ltd said on Monday that it had begun a “beta testing” program that allows 120 companies and government departments to try out its new BlackBerry 10 smartphones before their global launch on January 30.


The Canadian company, which is trying to reverse a sharp decline in market share for the BlackBerry, said the program would enable so-called enterprise customers in business and government to size up the BB10.






Features of the BB10 include the ability to separate personal and business information so that the user can store both without compromising security.


RIM has struggled in recent years to hold on to its base of enterprise customers, which typically pay a higher subscription fee than consumers, as their employees push to use devices such as Apple Inc’s iPhone for business as well as personal communications.


“This is a crucial step for us in getting our large enterprise customers ready to support BlackBerry 10 at the point of launch date, as opposed to post-launch date,” Bryan Lee, senior director for enterprise accounts, said in a phone interview.


RIM is providing the software and handsets at no charge, and the companies do not have to buy anything once the trial is finished.


The company plans to release its quarterly results on Thursday, and analysts expect it to report its third straight loss as it struggles to sell its older devices.


RIM made its name selling mobile email devices to bankers, lawyers and other professionals before expanding to sell phones to consumers.


The company said the BB10 testers were from financial, insurance, healthcare, manufacturing, media, and distribution industries and include 64 Fortune 500 companies, as well as government departments.


Lee would not identify any of the entities, beyond Integris Health and the U.S. Immigration and Customs Enforcement agency, which have both said they are testing the new devices.


The customers have installed test versions of RIM’s new server software, which manages iPhones and devices using Google Inc’s Android software as well as BlackBerrys, and will each receive two preproduction BlackBerry 10 handsets later this week.


RIM shares were down 2.1 percent at C$ 13.59 in morning Toronto Stock Exchange trading.


The stock has rallied from September’s multiyear lows around C$ 6.50 on a wave of optimism over the new devices, but the share price is still far below mid-2008 highs of around C$ 150.

President Obama meets with families of massacre victims

NEWTOWN, Conn.—





For President Barack Obama, it was another sorrowful visit to another grieving community full of broken hearts from unimaginable violence.


The spot, this time, was Newtown, Conn., where on Friday a man opened fire inside Sandy Hook Elementary School. The toll: 26 dead, including 20 boys and girls just 6 or 7 years old.








The president met privately Sunday afternoon at Newtown High School, about a mile and a half from Sandy Hook Elementary, with families of the victims and with emergency personnel who responded to the shootings.


 Obama, speaking at an interfaith vigil, offered the Connecticut town "the love and prayers of a nation."


The president says he is mindful that mere words cannot match the depth of the sorrow in Newtown, Conn.


Obama is telling the families of the victims that they are not alone in their grief. He says people all across the country have wept with them.


A White House official said Obama is the primary author of his speech and edited his remarks on the flight to Connecticut with presidential speechwriter Cody Keenan.


Keenan helped Obama write his speech last year following the shootings in Tucson, Ariz., that left six dead and 13 wounded, including Rep. Gabby Giffords.


"As a nation, we have endured far too many of these tragedies in the last few years," Obama said in his weekly radio address Saturday. "An elementary school in Newtown. A shopping mall in Oregon. A house of worship in Wisconsin. A movie theater in Colorado. Countless street corners in places like Chicago and Philadelphia."


Just last summer, Obama went to Aurora, Colo., to visit victims and families after a shooting spree at a movie theater in the Denver suburb left 12 dead. He went to Tucson, Ariz., in January of last year after six people were killed and 13 were wounded, including then-Rep. Gabrielle Giffords, outside a grocery store.


In November 2009, Obama traveled to Fort Hood, Texas, to speak at the memorial service for 13 service members who were killed on the post by another soldier.


"We have to come together and take meaningful action to prevent more tragedies like this. Regardless of the politics," Obama said in his broadcast remarks.


After the Colorado shooting in July, the White House made clear that Obama would not propose new gun restrictions in an election year and said he favored better enforcement of existing laws.


The Connecticut shootings may have changed the political dynamic in Washington, although public opinion in favor of gun control has declined over the years. While the White House has said Obama stands by his desire to reinstate a ban on military-style assault weapons, he has not pushed Congress to act.


Several Democratic lawmakers, during appearances on the Sunday talk shows, said the gruesome killings at the school were the final straw in a debate on gun laws that has fallen to the wayside in recent years.


"This conversation has been dominated in Washington by — you know and I know — gun lobbies that have an agenda," said Illinois Sen. Dick Durbin, the second-ranking Democrat in the Senate. "We need people, just ordinary Americans, to come together, and speak out, and to sit down and calmly reflect on how far we go."


Sen. Joe Lieberman, a Connecticut independent who is retiring, suggested a national commission on mass violence that would examine gun laws and what critics see as loopholes, as well as the mental health system and violence in movies and video games. Durbin said he supports the idea, and would add school safety to the list of topics to examine.


Sen. Dianne Feinstein, D-Calif., said she would push legislation next year to ban future sales of military-assault weapons like those used in the elementary school shooting. The bill will ban big clips, drums and strips of more than 10 bullets.


The proposals were among the first to come from Congress in the wake of Friday's shooting. Gun rights activists remained largely quiet on the issue, all but one declining to appear on the talk shows.


Rep. Louie Gohmert, R-Texas, defended the sale of assault weapons and said the principal at Sandy Hook Elementary School, who authorities say died trying to overtake the shooter, should have been armed.


Authorities identified the shooter as Adam Lanza, a 20-year-old who police say first killed his mother before driving to the school, opening fire in two classrooms and then taking his own life.


Before leaving for Connecticut, the president watched a dance rehearsal for one of his daughters in suburban Maryland.


As he said in his radio address, "this weekend, Michelle and I are doing what I know every parent is doing — holding our children as close as we can and reminding them how much we love them."

‘Hobbit’ bests ‘Rings’ with $84.8 million opening






NEW YORK (AP) — Peter Jackson‘s “The Hobbit” led the box office with a haul of $ 84.8 million, a record-setting opening better than the three previous “Lord of the Rings” films.


The Warner Bros. Middle Earth epic was the biggest December opening ever, surpassing Will Smith’s “I Am Legend,” which opened with $ 77.2 million in 2007, according to studio estimates Sunday. “The Hobbit: An Unexpected Journey” also passed the December opening of “Avatar,” which opened with $ 77 million. Internationally, “The Hobbit” also added $ 138.2 million, for an impressive global debut of $ 223 million.






Despite weak reviews, the 3-D adaptation of J. R. R. Tolkien‘s first novel in the fantasy series was an even bigger draw than the last “Lord of the Rings” movie, “The Return of the King.” That film opened with $ 72.6 million. “The Hobbit” is the first of another planned trilogy, with two more films to be squeezed out of Tolkien’s book.


While Jackson’s “Rings” movies drew many accolades — “The Return of the King” won best picture from the Academy Awards — the path for “The Hobbit” has been rockier. It received no Golden Globes nominations on Thursday, though all three “Rings” films were nominated by the Hollywood Foreign Press Association for best picture.


Particularly criticized has been the film’s 48-frames-per-second (double the usual rate), a hyper-detailed look that some have found jarring. Most moviegoers didn’t see “The Hobbit” in that version, though, as the new technology was rolled out in only 461 of the 4,045 theaters playing the film.


Regardless of any misgivings over “The Hobbit,” the film was a hit with audiences. They graded the film with an “A” CinemaScore.


“What’s really important, what makes this special is the CinemaScore,” said Dan Fellman, president of domestic distribution for Warner Bros. “All these things point to a great word of mouth. We haven’t even made it to the Christmas holidays yet. Kids are still in school this week.”


The strong opening culminated a long journey for “The Hobbit,” which was initially delayed when a lawsuit dragged on between Jackson and “Rings” producer New Line Cinema over merchandizing revenue. At one point, Guillermo del Toro was to direct the film with Jackson producing. But eventually the filmmaker opted to direct the movie himself, originally envisioning two “Hobbit” films. The production also went through the bankruptcy of distribution partner MGM and a labor dispute in New Zealand, where the film was shot.


The long delay for “The Hobbit,” nearly a decade after the last “Lord of the Rings” film, made it “one of those movies that had everyone scratching their heads as to how it would open,” said Paul Dergarabedian, an analyst for box-office tracker Hollywood.com.


“It’s been a decade since the ‘Lord of the Rings‘ trilogy concluded,” said Dergarabedian. “There’s been so much anticipation for this film and having Peter Jackson back at the helm just made it irresistible both to fans and the non-initiated alike.”


The Hobbit” was far and away the biggest draw in theaters, with no other new wide release. Paramount’s “Rise of the Guardians” continued to draw the family crowd, with $ 7.4 million, bringing its cumulative total to $ 71.4 million. The Oscar contender “Lincoln” from Walt Disney crossed the $ 100 million mark, adding another $ 7.2 million to bring its six-week total to $ 107.9 million. And Sony‘s James Bond film “Skyfall,” with another $ 7 million domestically, drew closer to a global take of $ 1 billion.


The box office continued to be on the upswing and with anticipated releases like “Les Miserables,” ”Django Unchained” and “The Guilt Trip” approaching in the holiday moviegoing season. Dergarabedian expects the year to break the 2009 record of $ 10.6 billion. With some $ 10.2 billion in revenue thus far, he said, “We’re on track to be in that realm.”


Estimated ticket sales for Friday through Sunday at U.S. and Canadian theaters, according to Hollywood.com. Where available, latest international numbers are also included. Final domestic figures will be released Monday.

Mislabeled Foods Find Their Way to Diners’ Tables





ATLANTA — The menu offered fried catfish. But Freddie Washington, a pastor in Tuscaloosa, Ala., who sometimes eats out five nights a week and was raised on Gulf Coast seafood, was served tilapia.

Consumers are misled most frequently when they buy fish, investigators say, because diners have such limited knowledge about seafood. 







It was a culinary bait and switch. Mr. Washington complained. The restaurant had run out of catfish, the manager explained, and the pastor left the restaurant with a free dinner, an apology and a couple of gift certificates.


“If I’m paying for a menu item,” Mr. Washington said, “I’m expecting that menu item to be placed before me.”


The subject of deceptive restaurant menus took on new life last week when Oceana, an international organization dedicated to ocean conservation, released a report with the headline “Widespread Seafood Fraud Found in New York City.”


Using genetic testing, the group found tilapia and tilefish posing as red snapper. Farmed salmon was sold as wild. Escolar, which can also legally be called oil fish, was disguised as white tuna, which is an unofficial nickname for albacore tuna.


Every one of 16 sushi bars investigated sold the researchers mislabeled fish. In all, 39 percent of the seafood from 81 grocery stores and restaurants was not what the establishment claimed it was.


“This thing with fish is age old, it’s been going on forever,” said Anne Quatrano, an Atlanta chef who opened Bacchanalia 20 years ago and kick-started the city’s sustainable food movement. “Unless you buy whole fish, you can’t always know what you’re getting from a supplier.”


Swapping one ingredient for a less expensive one extends beyond fish and is not always the fault of the person who sells food to the restaurant. Many a pork cutlet has headed to a table disguised as veal, and many an organic salad is not.


The term organic is regulated by the Department of Agriculture, but many other identifying words on a menu are essentially marketing terms. Unscrupulous chefs can falsely claim that a steak is Kobe beef or say a chicken was humanely treated without penalty.


In cases of blatant mislabeling, a chef or supplier often takes the bet that a local or federal agency charged with stopping deceptive practices is not likely to walk in the door. “This has been going on for as long as I’ve been cooking,” said Tom Colicchio, a New York chef and television personality. “When you start really getting into this stuff, there’s so many things people mislabel.”


At Mr. Colicchio’s New York restaurants, all but about 5 percent of the meat he serves is from animals raised without antibiotics, he said. It costs him about 30 percent more, so he charges more. “Yet I have a restaurant down the street that says they have organic chicken when they don’t, and they charge less money for it,” he said. “It’s all part of mislabeling and duping the public.”


Consumers are misled most frequently when they buy fish, investigators say, because there are so many fish in the sea and such limited knowledge among diners. The Food and Drug Administration lists 519 acceptable market names for fish, but more than 1,700 species are sold, said Morgan Liscinsky, a spokesman with the agency.


Marketing thousands of species in the ocean to a dining public who often has to be coaxed to move beyond the top five — shrimp, tuna, salmon, pollock and tilapia — is not an exact science.


The line between marketing something like Patagonian toothfish as Chilean sea bass or serving langostino and calling it lobster is a fine one.


Robert DeMasco, who owns Pierless Fish, a wholesaler in New York, used a profanity to describe someone who buys farm-raised fish and sells it as wild. “But on some of this, they’re splitting hairs,” he said.


In 2005, a customer sued Rubio’s, a West Coast taco chain, for misleading the public by selling a langostino lobster burrito. The FDA ruled that practice acceptable, which allowed chains like Long John Silver’s and Red Lobster to sell the crustacean called langostino and legally attach the word lobster to it. Maine lobstermen and lawmakers fought the decision unsuccessfully.

Hillshire Brands starting up in new space

Hillshire Brands was literally on the move this past week.


The $4 billion meat company, carved from Sara Lee Corp. and anchored by Hillshire Farm, Jimmy Dean and Ball Park brands, moved from a gleaming, glassy corporate campus in Downers Grove — complete with a fountain in a man-made lake — into a refurbished industrial building in Chicago's noisy West Loop.


Aside from the logistical ballet in relocating about 600 employees and contractors, the move is expected to stimulate a new and innovative culture that Hillshire needs for growth.








Sara Lee began working on the move about a year ago when it signed a lease for the building at 400 S. Jefferson St. After spinning off its international beverage business, Sara Lee changed its name to Hillshire Brands in June and turned to a new management team. CEO Sean Connolly calls the move part of Hillshire's "rebirth."


On Wednesday evening, technical staff began disconnecting office computers, and employees were asked to work from home.


Moving trucks arrived in Downers Grove on Thursday and were to haul office contents in reusable plastic crates 23 miles to the new space by Friday evening. On Saturday, IT staff were to reconnect computers, copiers and printers with the expectation that on Monday, Hillshire employees can begin work. The company has declined to say how much it's spending on the move or building out the new space.


Moving a corporate headquarters is a complex undertaking.


"It's really about those hundreds of details you have to keep track of," explained Brian Hunter, a 12-year veteran of the company's real estate department whose team orchestrated the move. He came with plenty of experience. Seven years ago he consolidated three company offices and 1,100 employees at the Downers Grove campus. But this move is part of something bigger.


"This isn't a coming together under one roof," Hunter said. "It's completely different, a rebirth if you will. We've disposed of several businesses, spun off some things and emerged with a new name, new culture and new leadership. And that was a reason for selecting a location where Hillshire could take the entire building, rather than rent a few floors in a skyscraper.''


A major challenge was making the move work within four months, starting Aug. 1, when Hillshire got access to the interior of the building. That's when crews began constructing pantries, kitchens, cubicle pods, offices, conference rooms and private phone booths, a nod to employees who lost offices as part of a more open floor plan.


Built in 1944 to house a lithograph company, the building is probably known to thousands of baby boomers because it was used as an examining and entrance station for inductees into the armed forces during the Vietnam War.


The building largely was vacant when Sterling Bay Cos. purchased it late last year, then spent $24 million on renovations over roughly an eight-month period. Windows were added, walls and two internal water towers were taken down, and the roof was replaced.


The space's modern look — white walls and splashes of lime green and bright orange in the furniture and upholstery — is offset by lingering elements of the old building. For instance, holes from old conduit boxes still show, an effort to be "authentic," Hunter said.


Open communication


A lesson Hunter learned from the office consolidation seven years ago is that there's no such thing as too much communication. Earlier this year he launched a monthly newsletter called "the 411 on 400" a nod to the company's new address on South Jefferson Street. Recently it morphed into a weekly email, reminding employees how to pack and when, and what to expect. The tone was lighthearted. In keeping with his jovial spirit, Hunter dusted off his old hard hat from the last move. It has a Sara Lee logo on one side, so he slapped a Hillshire Brands sticker on the other.


Town hall meetings were held, at which employees were shown mock-ups of their future workspaces and photos of what was being built. Hunter's presentations included virtual tours. In addition, some team leaders took their people on building tours. Some made practice runs of their new commutes, as some employees' trips will lengthen significantly.


With the idea of getting employee buy-in, Hunter's team put four types of cubicles on display at the company's campus and asked for feedback. Employees voted for their favorites online, and the company purchased the cubicles with the most votes.


The communication efforts appear to have made a difference.


"I have never felt like I was in the dark," said Mike Schwartz, a 31-year-old assistant brand manager for Ball Park. He also credited Hunter's team with having "done a very good job being honest about the move."


Schwartz, who lives in Glenview, had a 35-minute driving commute to Downers Grove. The move to the West Loop will stretch his commute beyond an hour. That includes driving to the train, a Metra ride and walking to the office. But Schwartz said he's looking forward to the "excitement and energy" of a downtown work environment. He's also looking forward to catching up with grad school friends who live in the city, either at lunch or with beers after work.

Crowd reacts after robbery suspect shot to death by police









A man suspected of robbing a truck driver Saturday was shot to death by police a short time later following what Chicago police called a “very violent encounter” in the Back of the Yards neighborhood that later sparked a mob reaction at the scene.

The shooting happened just before 11:30 a.m. Saturday in the 1600 block of West Garfield Boulevard near a gas station, police said.

A melee ensued when a crowd gathered after the shooting, with relatives of the dead man — identified as Jamaal Moore, 23 — accosting police officers and throwing bottles, bricks and rocks, said Chicago Police Superintendent Garry McCarthy. One family member assaulted an officer and was arrested, McCarthy said at an unrelated news conference.

Another eight people also were arrested at the scene, McCarthy said, adding that he had no information about how many officers were injured in the confrontation.

The chain of events began when robbers with guns held up a truck driver near 38th Street and Kedzie Avenue between 10 a.m. and 11 a.m., authorities said, citing preliminary information.

Several suspects in an SUV were reported to have broken into a stopped truck. The driver had gotten out of his truck and confronted the thieves, and they pulled out a weapon, said Patrick Camden, spokesman for the Fraternal Order of Police Lodge 7.

The driver called 911 and told a police dispatcher that the robbers were probably armed, Camden said.

Police chased the silver SUV until the vehicle lost control near Garfield Boulevard Ashland Avenue, striking a light pole, authorities said.

About five suspects then ran from the crashed SUV, McCarthy said, adding that four of them remain at large. One police car responding to the scene skidded onto the pavement and may have hit Moore as he tried to get away, McCarthy said.

A male and a female officer from that police car jumped out to confront Moore, who then got into a violent struggle with the male officer, throwing the officer to the ground twice, McCarthy said. Moore is listed in court records as 6-foot-1 and 205 pounds.

While still struggling with Moore, the male officer then yelled that the suspect had a gun, after seeing Moore reach for something in his pocket, McCarthy said.

“It was reported as a gunpoint robbery so the officers had good reason to believe that there was a gun there,” McCarthy said.

After throwing the male officer to the ground a second time, Moore charged at the female officer, McCarthy said.

“Based on the male officer saying that he had a gun, she was in fear and she fired twice, striking him,” McCarthy said. Police later determined that Moore was holding a flashlight, McCarthy said.

Both officers were taken to Mercy Hospital and Medical Center, but officials said they did not know their conditions. Moore was taken to Saint Bernard Hospital and Health Care Center, where he was declared dead at 12:13 p.m.

Court records show that Moore had been charged with crimes about a dozen times since 2006. In a 2007 case, he was convicted of armed robbery and sentenced to 6 years in prison.

On Nov. 26 of this year, he pleaded guilty to a felony aggravated fleeing charge, a crime related to attempting to escape arrest. Details of that incident were not available Saturday, but Moore had been given 24 months probation and was sentenced to 60 hours of community service plus fines, court records show.

At the scene of the shooting, the crowd that gathered afterward included some who identified themselves as relatives of Moore. Word spread quickly that Moore had been already handcuffed when he was shot, an account bystanders heard from others who said they witnessed the shooting and that was shared by two people who called the Tribune.

McCarthy said he had no information about whether that was the case.

“To my knowledge, it's nothing about handcuffs,” McCarthy said. “There is in-car video that is going to support this detailed story.”

Said Camden: “If he were handcuffed, we wouldn’t have a reason to shoot him.”

Chicago Police Sgt. Michael Martin, speaking near where the shooting took place, said people there were reacting with anger.

“People were throwing bricks and bottles at cop cars,” Martin said. “A few squad cars are damaged.”

Police responded by sending in several brigades of officers and closing off the area to traffic until the tensions eased and the damaged SUV was towed from the crash scene.

It’s OK to crank up the music, Florida Supreme Court rules






TALLAHASSEE, Florida (Reuters) – Motorist Richard Catalano‘s five-year quest to crank up Justin Timberlake tunes on his way to work won the blessing of the Florida Supreme Court on Thursday.


In a unanimous ruling, the state’s highest court affirmed a pair of lower-court opinions that a 2007 state law prohibiting loud music while driving violated the U.S. Constitution’s First Amendment, which guarantees freedom of expression.






Catalano received a $ 73 ticket in 2007 for violating the newly enacted law that prohibited motorists from playing music that is “plainly audible” 25 feet away. Motorists traveling by hospitals, schools and churches were subjected to even stricter standards.


Catalano, a Clearwater lawyer, challenged the law as subjective, arguing that determining whether music was too loud was in the ears of the beholder.


Further, the law provides listeners with fewer protections than drivers of vehicles emitting political or commercial speech, who have more explicit protections under the U.S. Constitution.


Calling the law overly broad, Justice Jorge Labarga wrote that noncommercial speech was also protected. Though rejecting the notion that the law was too vague, Labarga said the state showed no compelling interest in muzzling audiophiles who also prefer to feel their favorite music.


“The right to play music, including amplified music, in public fora is protected under the First Amendment,” Labarga wrote.


A message left with Catalano was not immediately returned Thursday.

School Yoga Class Draws Religious Protest From Christians

ENCINITAS, Calif. — By 9:30 a.m. at Paul Ecke Central Elementary School, tiny feet were shifting from downward dog pose to chair pose to warrior pose in surprisingly swift, accurate movements. A circle of 6- and 7-year-olds contorted their frames, making monkey noises and repeating confidence-boosting mantras.




Jackie Bergeron’s first-grade yoga class was in full swing.


“Inhale. Exhale. Peekaboo!” Ms. Bergeron said from the front of the class. “Now, warrior pose. I am strong! I am brave!”


Though the yoga class had a notably calming effect on the children, things were far from placid outside the gymnasium.


A small but vocal group of parents, spurred on by the head of a local conservative advocacy group, has likened these 30-minute yoga classes to religious indoctrination. They say the classes — part of a comprehensive program offered to all public school students in this affluent suburb north of San Diego — represent a violation of the First Amendment.


After the classes prompted discussion in local evangelical churches, parents said they were concerned that the exercises might nudge their children closer to ancient Hindu beliefs.


Mary Eady, the parent of a first grader, said the classes were rooted in the deeply religious practice of Ashtanga yoga, in which physical actions are inextricable from the spiritual beliefs underlying them.


“They’re not just teaching physical poses, they’re teaching children how to think and how to make decisions,” Ms. Eady said. “They’re teaching children how to meditate and how to look within for peace and for comfort. They’re using this as a tool for many things beyond just stretching.”


Ms. Eady and a few dozen other parents say a public school system should not be leading students down any particular religious path. Teaching children how to engage in spiritual exercises like meditation familiarizes young minds with certain religious viewpoints and practices, they say, and a public classroom is no place for that.


Underlying the controversy is the source of the program’s financing. The pilot project is supported by the Jois Foundation, a nonprofit organization founded in memory of Krishna Pattabhi Jois, who is considered the father of Ashtanga yoga.


Dean Broyles, the president and chief counsel of the National Center for Law and Policy, a nonprofit law firm that champions religious freedom and traditional marriage, according to its Web site, has dug up quotes from Jois Foundation leaders, who talk about the inseparability of the physical act of yoga from a broader spiritual quest. Mr. Broyles argued that such quotes betrayed the group’s broader evangelistic purpose.


“There is a transparent promotion of Hindu religious beliefs and practices in the public schools through this Ashtanga yoga program,” he said.


“The analog would be if we substituted for this program a charismatic Christian praise and worship physical education program,” he said.


The battle over yoga in schools has been raging for years across the country but has typically focused on charter schools, which receive public financing but set their own curriculums.


The move by the Encinitas Union School District to mandate yoga classes for all students who do not opt out has elevated the discussion. And it has split an already divided community.


The district serves the liberal beach neighborhoods of Encinitas, including Leucadia, where Paul Ecke Central Elementary is, as well as more conservative inland communities. On the coast, bumper stickers reading “Keep Leucadia Funky” are borne proudly. Farther inland, cars are more likely to feature the Christian fish symbol, and large evangelical congregations play an important role in shaping local philosophy.


Opponents of the yoga classes have started an online petition to remove the course from the district’s curriculum. They have shown up at school board meetings to denounce the program, and Mr. Broyles has threatened to sue if the board does not address their concerns.


The district has stood firm. Tim Baird, the schools superintendent, has defended the yoga classes as merely another element of a broader program designed to promote children’s physical and mental well-being. The notion that yoga teachers have designs on converting tender young minds to Hinduism is incorrect, he said.


“That’s why we have an opt-out clause,” Mr. Baird said. “If your faith is such that you believe that simply by doing the gorilla pose, you’re invoking the Hindu gods, then by all means your child can be doing something else.”


Ms. Eady is not convinced.


“Yoga poses are representative of Hindu deities and Hindu stories about the actions and interactions of those deities with humans,” she said. “There’s content even in the movement, just as with baptism there’s content in the movement.”


Russell Case, a representative of the Jois Foundation, said the parents’ fears were misguided.


“They’re concerned that we’re putting our God before their God,” Mr. Case said. “They’re worried about competition. But we’re much closer to them than they think. We’re good Christians that just like to do yoga because it helps us to be better people.”

Greener planet is goal for 3 startups









If the glut of companies billing themselves as "solutions" providers is any indication, the world has no shortage of problems.


Green tech companies take on some of the most complicated, difficult problems to solve. They tend to be problems created by our mere existence, chief among them our massive demand for energy. The more we rely on energy to power our electronics, our vehicles and our lives, the more pollution we churn into our land, water and air.


The Tribune checked in with three local green tech startups at various stages of development. They haven't changed the world yet, but they're working on it.





COMPANY: LanzaTech


PROBLEM TO BE SOLVED: Global warming, a huge challenge as energy demand is expected to double within 40 years.


FUNDS RAISED: $100 million


It may sound like sci-fi, but LanzaTech produces gas-eating "bugs" that don't require oxygen to survive.


In April, the company's microscopic bacteria began ingesting carbon monoxide from a steel mill in China. Carbon monoxide goes in one end of the bacteria and ethanol comes out the other.


With a few genetic tweaks, the bug can produce a wide range of fuels and chemicals from gases that companies spend money to get rid of. The idea, says Jennifer Holmgren, the company's chief executive, is to trap nasty gases that float from steel mills, power plants and chemical factories, turning them into products that are useful and profitable.


The company recently inked a deal with Petronas, the national oil company of Malaysia, to develop a modified version of the bug that takes in carbon dioxide and produces acetic acid, a chemical companies need to produce polymers used in plastics.


"Rather than trying to sequester carbon deep into the earth, we will 'bury' it in a chemical," Holmgren said. "In this way, companies can not only comply with emissions reduction requirements, but also generate revenue along the way."


When Holmgren talks about the technology's potential, she pulls up a map of the world, showing partnerships and agreements the company has with companies from Boeing Co. in Chicago and Kansas-based Invista, the world's largest nylon producer, to Indian Oil Co. in New Delhi and Mitsui & Co. Ltd. in Japan.


Out of the company's various projects, the carbon monoxide-eating bacteria are the furthest along in the path toward commercialization. This month, LanzaTech finished a demonstration project for China's largest steel manufacturer, Baosteel, at a plant near Shanghai.


LanzaTech successfully produced the equivalent of more than 100,000 gallons of ethanol per year from just a fraction of the carbon monoxide the company creates in the steel-making process.


"You're literally driving for miles watching this steel mill," Holmgren said, explaining its vast size — and its potential to produce hundreds of millions of gallons of ethanol per year.


The technology creates a financial incentive to trap the gas rather than flare it, a common practice that produces carbon dioxide, which contributes to global warming. Through a series of pipes, the gas enters a vessel filled with the organism, which is floating in water. Fuel comes out the back end and is pumped through a distiller to create pure ethanol.


Because of the success of that demonstration, the steel company has ordered the first of what will eventually be three or four units, each about $80 million, that are each expected to produce 30 million to 50 million gallons of ethanol per year. Each unit pays itself back in under five years, Holmgren said.


"We don't want it to be green for green's sake. If it is, no one is going to use it," she said.


With 140 employees worldwide, LanzaTech doesn't have any revenues to report yet. Holmgren said LanzaTech expects to grow to profitability between 2013 and 2015.
